Terms and conditions of sale

1. Description of the seller

This website www.ballettodanceshop.com is published by SAS BALLETTO, trading name Balletto Dance Shop, with capital of €1,428, located at 25, rue Condillac, 33000 Bordeaux.

2. Purpose of the GTCS

The General Terms and Conditions apply exclusively to the online sale of products by Balletto Dance Shop on its commercial website www.ballettodanceshop.com.
They are written in French. In the event of any doubt as to the interpretation of a translation, only the original French version shall be deemed authentic.

2.1 Scope of application

The GTCS exclusively govern online sales contracts concluded between Balletto Dance Shop (the seller) and consumers (buyers in this capacity).
Together with the order confirmation email, they constitute the only contractual document.
They do not preclude the right of withdrawal provided for by law.

2.2 Availability and enforceability

The General Terms and Conditions can be accessed at any time on the site. The consumer accepts them unreservedly by ticking the appropriate box when placing an order.

2.3 Modifications

The seller may amend the GTC at any time, without notice or compensation.
The applicable GCS are those in force on the date of the order.

2.4 Severability clause

If a clause is deemed invalid, it will be deemed unwritten, without affecting the other clauses.
The temporary or definitive inapplicability of one or more clauses does not constitute a waiver of their application.

3. Product characteristics

Consumers can obtain further information on request from Customer Services.
Each product is accompanied by a description of its essential characteristics.
Consumers who order without requesting additional information are deemed to accept the product as is.
Photographs are non-contractual. Variations may exist (colour, materials, finishes, etc.).
Typographical errors are possible.

4. Selling prices

In accordance with article L.113-13 of the French Consumer Code, prices are quoted in euros, inclusive of all taxes and excluding delivery costs.
Delivery costs are specified before the order is confirmed and added to the total amount.
The total to be paid is displayed on the order confirmation page.

4.1 Price changes

Prices are subject to change at any time.
However, the price applicable is that in force on the date of the order.

5. Order: conclusion of contract

To order, customers fill in their shopping basket, select the products (size, colour, quantity), then click on "add to basket".
The customer then confirms the order by ticking the box "I have read the general terms and conditions of sale and accept them unreservedly".
A confirmation email is then sent.
The consumer must provide accurate and complete information (email, address, surname, first name, telephone).
The seller shall not be held liable in the event of a data entry error.

5.1 Changing the order

Any modification after confirmation is subject to acceptance by the seller and to the availability of the products.
This must be done before the order is prepared (usually within 24 hours, but it may be shorter).
The seller may refuse a late amendment.

5.2 Order validation

The seller reserves the right to refuse an order for legitimate reasons (abnormal quantity, existing dispute, etc.).
In the event of refusal, the refund will be made promptly.

5.3 Unavailability of products

If one or more products are unavailable, the seller will inform the customer.
It may offer an equivalent product, a refund or a credit note.

6. Rescission of the contract

The contract may be terminated by the seller in the following cases:

Refusal to accept by the customer

Return of parcel due to incorrect address

Non-payment
In such cases, any deposits paid shall be retained by the seller as compensation.

7. Withdrawal

Customers have a statutory period of 14 days from receipt to exercise their right of withdrawal.
No proof is required. The cost of returning goods is borne by the consumer.
To exercise this right, an email must be sent to contact@ballettodanceshop.com, mentioning the order number, the customer's first and last name and any other useful information.
Refunds will be made within 3 days of receipt of the returned products.
Products must be in their original condition (unworn, unwashed, with labels, in the original packaging, with the invoice).
Any non-conforming returns will be refused.
The risks associated with the return are the responsibility of the customer. It is recommended to use a shipment with tracking, delivery against signature and insurance.

8. Returns

In the event of an error in size or colour, Balletto will send the correct product free of charge after the customer has returned it at his expense (by Colissimo only).
Products must be returned within 14 days to the following address:
Balletto Dance Shop, 25 Rue Condillac - 33000 Bordeaux.
Terms and conditions:

Sale or promotional items: no returns, no exchanges, no refunds

Tights, underwear, hair accessories: no exchanges or refunds

Personalised products: no exchange or refund

Products opened for hygiene reasons: no returns

Items returned: intact, with labels, original packaging, unwashed, unworn
Any non-conforming returns will be refused.
Balletto reserves the right to offer a credit note or a refund.

9. Payment

Payment is due in full as soon as the order has been confirmed.
Payment is made via a secure Crédit Lyonnais (LCL) platform or by bank transfer.
Bank details do not pass through the seller's server.

10. Delivery

There is no entitlement to compensation for delays due to external causes.
Products are delivered to the address indicated.
If the product is received without reservation, it is deemed to have been accepted as is.
In the event of damage, the customer must :

express reservations on acceptance

confirm these reservations to the carrier by registered letter within 3 days
In the event of non-conformity, the customer may request an exchange or cancellation of the sale.

11. Legal warranties

All products benefit from :

the legal guarantee of conformity (articles L.211-4 to L.211-14 of the French Consumer Code)

the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)
In the event of a defect, the product may be exchanged or refunded.

12. Waiver of liability

The seller is not liable for any errors made by the customer, nor for cases of force majeure or unforeseeable events.
Its obligation is one of means: it is deemed to have fulfilled its mission once the package has been handed over to the carrier.
Proof is provided by the signed deposit slip.

12.1 Penalty clause

In the event of non-performance by the customer, the advance payments shall be retained by the seller.

13. Resolutory clause

The order may be cancelled by registered letter with acknowledgement of receipt. It is acquired by operation of law, without any legal formalities.

14. Intellectual property rights

The elements of the site are the exclusive property of the publisher.
They are protected by copyright, trademarks and patents.
No part of this website may be reproduced without written permission.

15. Personal data

The collection and use of data is subject to the customer's consent.
They are used solely to manage orders.
It is not shared with third parties, except payment and transport service providers.
Customers may access, modify or delete their data at any time, in accordance with the RGPD.

16. Settlement of disputes - Prior conciliation

In the event of a dispute, the customer undertakes to enter into direct conciliation with the seller within 30 working days.

17. Territorial jurisdiction

In the event of a dispute, the competent court is that of the defendant's domicile.

18. Reproduction of legal articles

Article L211-4 of the Consumer Code
The seller is obliged to deliver goods that conform to the contract. He shall also be liable for defects relating to packaging, assembly or installation.
